The emerging issue of Social Work malpractice is investigated in this project through an examination of relevant Statute and Case law in both the United States and Australia. Social Workers in the United States have experienced the real threat of civil litigation for the part twenty years, and have responded accordingly. Thus registration of social workers is mandatory in the U.S. where practitioners work in an environment of fee-for-service practice. Increasingly however, U.S. workers are becoming cautious and a culture of defensive practice techniques have developed.
